PRIVACY POLICY

In the course of its activities as a casting agency, CoolWorks OOD (CoolWorks) processes information, including information that constitutes personal data.

This Privacy Policy is intended to inform you of the way we process your personal data as a data controller, and of your rights in this regard.

The protection of your personal data is of utmost importance to us. CoolWorks shall process your personal data in accordance with the Personal Data Protection Act, the General Data Protection Regulation (EU) 2016/679 (GDPR) and the applicable European and Bulgarian legislation. We strive to be as clear, specific and transparent as possible on the processing of your personal data.

1.      Types of data processed by CoolWorks

CoolWorks shall process personal data voluntarily provided by you, namely: names, addresses, e-mail addresses, telephone numbers, data regarding your age, sex, weight, height, other distinctive physical features, education, specific talents and skills.

2.      Purposes and period of processing

The personal data you provide shall be processed and used solely for the indicated purposes. These include, in particular:

-          Your registration and archiving in the CoolWorks OOD's database.

-          Your participation or multiple participations, in your capacity of a performer, in the production of audio-visual works produced within the meaning of the Copyright and Related Rights Act by third parties other than CoolWorks OOD;

CoolWorks shall store these data for a maximum of 5 (five) years from the date on which they are provided (unless longer storage periods are legally permissible for other reasons) with a view to a possible subsequent review of the submitted documents, except in cases where you have explicitly objected to such storage of the data provided in this connection.

In case a participant in our castings is under 18 years of age, we shall also require the explicit consent of a parent (legal representative) to the collection and processing of the minor's personal data.

3.      Provision or transfer of personal data

In some cases, CoolWorks may disclose certain personal information to its contractual partners. For cases where CoolWorks shares information about you with third parties, CoolWorks shall verify whether these third parties provide a data protection level according to the agreed standard for that. Your data is also considered confidential by our partners.

CoolWorks may provide your personal data if required by law, in a trial, litigation and/or at the request of public and government authorities in or outside your country of residence. We may also disclose information about you if we find out that such disclosure is necessary or appropriate for purposes of national security, law enforcement or other matters of public concern.

In case your data need to be transferred to third countries (outside the EU), CoolWorks shall perform this transfer in full compliance with the legal provisions, thus ensuring the level of protection of your data.

If your access to the CoolWorks website somehow connects you to accessing other social networks such as Facebook, Google +, YouTube, Tweeter, and others, CoolWorks shall not be responsible for the protection of your personal data in case you have accepted the terms and conditions of these websites.

4.      Your rights to data protection

In connection with the protection of your personal data, you have the following rights:

-          Right of access to personal data relating to the person which are processed by CoolWorks;

-          Right to rectify or supplement inaccurate or incomplete personal data;

-          Right to erasure (‘right to be forgotten’) of personal data that are processed unlawfully or on a legal basis that is no longer valid (expired storage period, withdrawn consent, completed primary purpose for which they were collected, etc.);

-          Right to restriction of processing - in the event of a legal dispute between CoolWorks and the data subject – until its resolution, and/or for the establishment, exercise or defence of legal claims;

-          Right to data portability – if processed in an automated manner on the basis of consent or contract. For this purpose, the data shall be provided in a structured, commonly used and machine-readable format. Where technically feasible, personal data may be transmitted directly from one controller to another. The right to data portability shall cover only data provided personally by the data subject as well as personal data generated and collected from his/her activity;

-          Right to object - at any time and on grounds relating to the particular situation of the person, provided that there are no compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or a trial;

-          The data subject shall have theright not to be subject to a decision based solely on automated processing, including profiling,which produces legal effects concerning him or her or similarly significantly affects him or her;

-          Right to lodge a complaint with the Commission for Personal Data Protection in case of violated rights of the data subject, as well as the right to appeal against CoolWorks's actions before the respective administrative court or before the Supreme Administrative Court under the general rules of litigation.

For your convenience, with respect to any of the foregoing rights, your requests may be submitted to CoolWorks in free text at your discretion.

Please submit your requests as well as any other questions to the contact point mentioned in item 7.

CoolWorks shall have the right to refuse to satisfy some of your requests in exercising your rights to personal data protection on the grounds provided by applicable law.

5.      Security of your personal data

CoolWorks uses a wide variety of data security measures (technical and organizational) to ensure the confidentiality and protection of your personal information.

All employees of CoolWorks are required to protect the confidentiality of your information and to observe the applicable organizational and technical measures for its protection.

After the expiration of the storage period, your personal data shall be erased (destroyed).

6.      Update of the CoolWorks Privacy Policy

In connection with the anticipated amendments to the data protection legislation, CoolWorks will periodically update and publish its Privacy Policy.
